Terms of Service

1. About these terms

These Terms of Service (the "Terms") govern your use of the Olakino mobile app, website and related services (together, the "Services"), provided by Olakino Oy (Business ID 3275660-3), a company registered in Finland ("Olakino", "we", "us"). How we handle your personal data is described in our Privacy Policy, which forms part of these Terms.

2. Who can use Olakino

You must be at least 18 years old and able to enter into a binding agreement to use the Services. The Services are for your own personal use.

3. What Olakino is

Olakino is a wellness app. It reads data you choose to share, such as sleep, heart rate variability, activity and meals from Apple Health, your wearable and your own entries, and turns it into a daily readiness picture and personal suggestions for everyday wellbeing. Connecting a continuous glucose monitor is optional; the core Services work without one.

We keep developing Olakino and may add, change or remove features. If a change materially reduces what your paid subscription gives you, we will tell you in advance and you may cancel.

5. AI coach & AI-generated insights

Some insights, summaries and coaching messages in Olakino are generated by artificial intelligence and are labelled as such in the app. AI output is based on your own data and patterns, can be incomplete or wrong, and is not professional advice. Use your own judgement and treat it as a starting point, not a conclusion. We only send your data to AI features after you have agreed to it in the app, and you can turn AI features off at any time.

The AI coach is in testing

The Olakino AI coach, which lets you ask questions and chat about your day, is a test feature. While it is in testing:

• you are talking to an AI, not a person, and the coach is a wellness companion only. It will not answer medical questions, interpret symptoms or give advice about any disease, medication or treatment, and section 4 applies to everything it says;
• its answers may be less reliable than the rest of the app, and it may be slow, limited or unavailable at times;
• we may offer it to some users only, change how it works, or withdraw it. It is included at no extra cost during testing and is not part of what the €6.99 subscription guarantees, so changes to it do not change your subscription price;
• what you write to the coach is processed to answer you and, if you agree in the app, to improve the coach, as described in our Privacy Policy. Please do not share information about other people;
• you can report an answer that seems wrong or unsafe from within the chat, or by email to the address in section 16. We review these reports.

If the AI coach becomes a paid or permanent feature, we will update these Terms and tell you before any change affects your subscription.

6. Subscription & price

Olakino is offered as a monthly subscription.

Where the App Store shows prices in another currency, the local price set by Apple applies.

• Payment. Subscriptions are bought through the Apple App Store and charged to your Apple ID. Apple processes the payment; we do not receive or store your card details.
• Automatic renewal. Your subscription renews automatically each month at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Cancelling. You can cancel at any time in your Apple ID subscription settings (Settings › your name › Subscriptions). Deleting the app does not cancel your subscription. After cancelling, you keep access until the end of the period you have paid for.
• Refunds. Because Apple handles billing, refund requests are made to Apple at reportaproblem.apple.com. This does not affect any right you have under consumer law.
• Right of withdrawal. If you are a consumer in the EU, you may have a statutory right to withdraw from the purchase within 14 days. Withdrawal is exercised through Apple under its terms.
• Free trials and offers. If we offer a free trial or introductory price, its length and what happens when it ends are shown before you confirm. Unless you cancel before the trial ends, it converts to a paid subscription.
• Price changes. If the price changes, you will be told in advance through the App Store and, where required, asked to agree before the new price applies. If you do not agree, you can cancel before it takes effect.

Visiting our website is free.

7. Your account

You are responsible for the accuracy of the information you give us, for keeping your device and login secure, and for activity under your account. Tell us promptly at pauliina@olakino.fi if you believe your account has been used without your permission.

You can delete your account and all associated data at any time in the app under Settings › Privacy › Delete account. Deleting your account does not cancel an App Store subscription; cancel that in your Apple ID settings as described above.

8. Acceptable use

You agree not to:

• use the Services unlawfully, or with anyone else's data without their consent;
• copy, reverse-engineer, disrupt or try to gain unauthorised access to the Services, except where the law allows it;
• upload malicious code or interfere with other users; or
• misrepresent your identity or your relationship to any data you provide.

9. Devices & third-party services

Olakino works with third-party devices and services such as Apple Health, wearables and glucose monitors. We are not responsible for those products, their accuracy or their availability, and your use of them is governed by their own terms. If a third-party connection changes or stops working, some Olakino features may be affected.

10. Intellectual property & your data

Olakino, its content, design, software and trademarks belong to Olakino Oy or our licensors. We grant you a limited, personal, non-transferable and revocable licence to use the app on Apple devices you own or control, as these Terms allow.

Your data remains yours. You allow us to process it only as needed to run the Services and give you insights, as described in our Privacy Policy. Health data is special-category data under the GDPR and is processed on the basis of your explicit consent.

11. Your rights & our liability

We will provide the Services with reasonable care and skill, and as a consumer you have statutory rights if the Services do not conform to these Terms, including under the Finnish Consumer Protection Act. Nothing in these Terms limits those rights.

Wellness insights depend on the data available and on your individual circumstances, so we cannot promise that every insight will be accurate or suited to you, or that the Services will always be uninterrupted.

To the extent the law allows, we are not liable for indirect or consequential losses, or for decisions you make against the guidance in section 4. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for gross negligence or intent, or for fraud.

12. Ending your use

You can stop using the Services and delete your account at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, or where the law requires it; if we end access for reasons other than your breach, we will refund any prepaid period you can no longer use. Sections that by their nature should continue (such as intellectual property, liability and governing law) still apply afterwards.

13. Apple App Store

If you downloaded Olakino from the Apple App Store, the following also applies:

• These Terms are between you and Olakino Oy only, not Apple. Olakino Oy, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Olakino Oy, not Apple, is responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app or your use of it infringes their intellectual property rights, Olakino Oy, not Apple, is responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

14. Governing law & disputes

These Terms are governed by the laws of Finland. If you are a consumer, you also keep the mandatory protections of the law of your country of residence and may bring proceedings in the courts of your home country. We would like to hear from you first so we can try to put things right. Consumers in Finland can also contact the Consumer Advisory Service (Kuluttajaneuvonta) and take a dispute to the Consumer Disputes Board (Kuluttajariitalautakunta). Consumers elsewhere in the EU can get help from the European Consumer Centre in their country.

15. Changes to these terms

We may update these Terms, for example when we change the Services or the law changes. We will post the new version here and update the date at the top. For significant changes we will tell you in the app or by email at least 30 days before they take effect. If you do not accept a change, you can cancel your subscription before it takes effect.
